1. Seller and contracting party

Your contracting party is Tobias Glück, trading as 8D Scan Pro, Bauerwiese 5, 30926 Seelze, Germany, email: info@8dscanpro.com. By using the service you enter into a contract with this seller.

2. Service description

8D Scan Pro is an AI-assisted service for reviewing and assessing 8D reports. It analyses uploaded reports, scores disciplines D1 to D8, and produces findings, improvement suggestions and a downloadable report.

3. Acceptance

By registering and continuing to use the service you accept these terms. You confirm that you are of legal age or authorised to act on behalf of your organisation.

4. Account and credentials

You must keep your credentials confidential, provide accurate information and keep it up to date. You are responsible for all activity under your account.

5. Licence and intellectual property

We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. All rights in the service, including software, documentation and branding, remain with the seller. Reverse engineering, resale, redistribution and circumvention of technical limits are prohibited.

6. AI content and user responsibility

Scores and recommendations are generated using artificial intelligence and may be inaccurate, incomplete or unsuitable. You must review results professionally and must not base decisions solely on AI content. You are responsible for your prompts, your use of outputs and your rights in uploaded content. You must not process illegal content, create deceptive or hateful content or malware, or attempt to bypass safeguards. We may remove content, refuse or filter outputs and suspend accounts for violations. Rights holders may report infringing uploaded content to info@8dscanpro.com; repeated infringement leads to suspension. Our AI and liability notice applies in addition.

7. User content

You grant us a limited licence to host and process uploaded content solely to provide the service. You confirm that you are entitled to submit it and do not infringe third-party rights.

8. Prohibited use

The service must not be misused, including for unlawful purposes, fraud or spam, infringement of third-party rights, or interference with the security of the service, such as malware, scraping or probing for vulnerabilities.

9. Pricing, payment and subscription

The prices shown at the time of ordering apply: three free reviews, then single reports, report packs or the monthly Pro subscription. The Pro subscription renews automatically each month and is cancellable monthly, effective at the end of the current billing month. Payment, billing, tax, cancellation and refund mechanics are additionally governed by Paddle's Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Availability

We do not guarantee uninterrupted or error-free performance. Maintenance, development and events beyond our control may cause limitations.

11. Disclaimer of warranties

To the fullest extent permitted by law, all implied warranties are disclaimed, including merchantability and fitness for a particular purpose. Mandatory statutory rights remain unaffected.

12. Liability

We have unlimited liability for intent and gross negligence, for injury to life, body or health, and where liability is mandatory by law. For a slightly negligent breach of an essential contractual obligation, liability is limited to the typical, foreseeable loss and to the fees paid in the preceding twelve months. Liability for other cases of slight negligence is excluded, in particular for indirect, consequential or special damages such as loss of profits or data. Our AI and liability notice applies in addition.

13. Indemnity

You indemnify us against third-party claims arising from your content, unlawful use or violations of these terms.

14. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious violations. After termination, stored content is deleted after reasonable periods; export results you need in good time.

15. Force majeure

We are excused from performance to the extent and for as long as events beyond our reasonable control prevent it.

16. Assignment

You may assign rights under this contract only with our consent. We may assign the contract as part of a merger or acquisition.

17. Governing law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this applies only insofar as mandatory consumer protections at their place of residence are not withdrawn. Where permitted, the venue is our registered seat.
